1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your access to and use of HarveyStanbrough.com (the “Site”), operated by Harvey Stanbrough (“I,” “me,” or “my”). By using the Site, you agree to these Terms and to my Privacy Policy. If you do not agree, please do not use the Site.
2. About the Site
The Site is the personal website of a fiction author. It provides information about my novels, novellas, short stories, collections, and poetry, as well as articles and resources for readers and writers, and links to my publisher, newsletters, and retailers. The Site does not itself sell products or process payments.
3. Intellectual Property
All content on the Site, including text, articles, blog posts, images, graphics, cover art, and design, is owned by me or used with permission, and is protected by U.S. and international copyright law. All rights are reserved unless stated otherwise.
You may:
view the Site and its content for personal, non-commercial use;
share links to the Site and its pages; and
quote brief excerpts for review, commentary, or criticism, with clear credit and a link back to the original page.
You may not, without my prior written permission:
copy, republish, sell, or distribute the Site’s content, in whole or in substantial part;
use any content on the Site, including text and images, to train, fine-tune, or test any artificial intelligence or machine learning model, or to scrape or harvest it for that purpose; or
remove copyright notices or misrepresent the authorship of any content.
All titles, pen names, and logos are my property or that of their respective owners. Nothing in these Terms transfers any ownership rights to you.
4. Books, Purchases, and Donations
Books, stories, and other products linked from the Site are sold by third parties such as StoneThread Publishing, Payhip, Amazon, and other retailers. Those sales are governed by the terms, pricing, delivery, and refund policies of the seller, not these Terms. Please contact the seller about any order issue.
Donations made through the PayPal link are voluntary gifts. They are non-refundable except where required by law, and they are not tax-deductible charitable contributions. Donating gives you no rights, products, or services in return.
5. Comments and User Contributions
Where comments are enabled, you are responsible for what you post. By submitting a comment, you confirm that it is your own work and that you have the right to post it, and you grant me a non-exclusive, royalty-free, worldwide license to display, store, and reproduce it on the Site.
I may edit, hold, or remove any comment at any time, for any reason. Comments must not:
be unlawful, defamatory, harassing, hateful, threatening, or obscene;
infringe anyone’s intellectual property or privacy rights;
contain spam, advertising, malware, or unsolicited promotion; or
impersonate any person or misrepresent your identity.
Opinions expressed in comments belong to their authors and not to me.
6. Acceptable Use
You agree not to use the Site to break any law; to interfere with or disrupt the Site or its servers; to attempt unauthorized access to the Site or its systems; or to use bots, scrapers, or other automated means to access the Site in a way that burdens it or violates these Terms.
7. Third-Party Links
The Site contains links to websites and services I do not own or control, including Substack, PayPal, Payhip, retailers, and social media platforms. I am not responsible for their content, practices, or availability. A link does not mean I endorse the site or its owner. You access third-party sites at your own risk.
8. Nature of the Content
My fiction is fiction. Characters, events, and settings are products of imagination, and any resemblance to real people or events is coincidental unless stated. My articles and writing-craft material reflect my personal views and experience as a professional writer. They are provided for information and entertainment only and are not a guarantee of any writing, publishing, or financial result.
Some works are published under pen names, as described on the Site. They remain subject to these Terms.
9. Disclaimer of Warranties
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. I do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Site or reliance on its content, even if I have been advised of the possibility of such damages. If I am found liable, my total liability to you will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold me harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, your comments or contributions, or your misuse of the Site.
12. Copyright Complaints
If you believe content on the Site infringes your copyright, please send a written notice to the contact details below, identifying the work, the allegedly infringing material and its location on the Site, your contact information, and a statement made in good faith that the use is unauthorized. I will review and respond promptly.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Arizona, and you consent to their jurisdiction. Nothing here limits any consumer rights you have under mandatory laws of your own country.
14. Changes to These Terms
I may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of the Site after changes are posted means you accept the revised Terms.
15. General
If any part of these Terms is found unenforceable, the rest remains in effect. My failure to enforce any provision is not a waiver of it. These Terms and the Privacy Policy are the entire agreement between you and me regarding the Site.
